Terms of Service

These Terms of Service (“Terms”) govern access to and use of radness.co, related games and pages, and the Hermes Citadel application and integrations (collectively, the “Services”). By accessing or using the Services, connecting a Google account, or clicking to accept these Terms, you agree to them. If you do not agree, do not use the Services.

The Services depend on third parties (for example Google APIs, Cloudflare, AI model providers). Their terms and availability are outside our control. We are not responsible for third-party outages, policy changes, or API limits.

9. Experimental / personal-use nature

Unless we expressly offer a paid enterprise agreement, the Services are provided as experimental or personal productivity tools. Availability, support, and SLAs are not guaranteed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED, OR FREE OF ERRORS OR HARMFUL COMPONENTS, OR THAT EMAIL OR OTHER ACTIONS WILL BE SENT OR PROCESSED AS EXPECTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADNESS CO. AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

12. Indemnity

You will defend and indemnify Radness Co. and its operator against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your content, your violation of these Terms, or your violation of law or third-party rights (including misuse of Google APIs or email).

13. Suspension and termination

You may stop using the Services at any time and revoke Google access. We may suspend or terminate access immediately if you violate these Terms, if required by law or Google policy, or if continued operation creates risk. Provisions that by nature should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.

14. Export and sanctions

You may not use the Services if you are prohibited under US or other applicable export control or sanctions laws.

15. Governing law and disputes (USA)

These Terms are governed by the laws of the State of Missouri, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Except where prohibited, courts located in Missouri will have exclusive jurisdiction over disputes. Consumers in the EU/UK may have mandatory rights to bring claims in their country of residence.

16. EU consumer terms

If you are a consumer in the EEA/UK, nothing in these Terms limits mandatory statutory rights that cannot be waived by contract. You may be entitled to withdraw from certain distance contracts where applicable law provides a cooling-off right; purely digital services performed with your prior express consent may be exempt as permitted by law.

We may update these Terms by posting a revised version at https://radness.co/terms and updating the date above. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.
