1. Who may use the Services

• You must be at least 13 years old (or the higher age of digital consent in your country) to use Hermes Citadel and Google-connected features.
• If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
• You must comply with these Terms, our Privacy Policy, Google’s terms and policies for any Google APIs you authorize, and applicable law (including US and EU law).

2. The Services

Radness Co. provides:

• Website & games on radness.co (entertainment and experimental projects); and
• Hermes Citadel, a personal AI agent that can connect to Google services (such as Gmail, Calendar, Drive, Contacts, Sheets) via OAuth so it can help you manage information and take actions you request.

Features may change, break, or be discontinued. We do not guarantee uninterrupted or error-free operation.

3. Accounts, authentication, and Google access

• Some features require Google OAuth. You control which scopes you grant and may revoke access at any time at Google Account permissions.
• You are responsible for activity under your connected accounts and for keeping credentials and devices secure.
• You must not attempt to bypass security, probe for vulnerabilities without authorization, or access another person’s data without permission.

4. Acceptable use

You agree not to use the Services to:

• Violate law, including privacy, spam, export, sanctions, or computer-abuse laws.
• Send spam, phishing, malware, or deceptive messages via Gmail or any connected channel.
• Infringe intellectual property or other rights.
• Harass, exploit, or harm others; or process special-category data unlawfully.
• Interfere with or disrupt the Services, games, leaderboards, or infrastructure.
• Misrepresent the Services as a Google product or misuse Google branding.
• Use Google user data obtained through Hermes Citadel except as allowed by these Terms, the Privacy Policy, and Google’s policies.

We may suspend or terminate access for violations or risk to users, Google accounts, or our systems.

5. AI-generated actions and human responsibility

• Hermes Citadel uses AI models that can be incorrect, incomplete, or inappropriate.
• You are responsible for reviewing drafts and confirming actions (especially sending email, deleting data, or sharing files) before they take effect when confirmation is required.
• Do not rely on Hermes Citadel as a sole source for legal, medical, financial, or other professional advice.

6. Privacy

Our Privacy Policy explains how we collect and use personal data, including Google user data and GDPR/CCPA-related rights. By using the Services, you acknowledge that policy.

7. Intellectual property

• We and our licensors own the Services, branding, site design, and original game content, excluding your content and third-party materials.
• You retain ownership of content you submit (for example leaderboard names, prompts, and your Google data). You grant us a limited license to host and process that content solely to operate the Services for you.
• “Google,” “Gmail,” and related marks are trademarks of Google LLC. Hermes is not endorsed by Google.

8. Third-party services

The Services depend on third parties (for example Google APIs, Cloudflare, AI model providers). Their terms and availability are outside our control. We are not responsible for third-party outages, policy changes, or API limits.

9. Experimental / personal-use nature

Unless we expressly offer a paid enterprise agreement, the Services are provided as experimental or personal productivity tools. Availability, support, and SLAs are not guaranteed.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE SECURE, UNINTERRUPTED, OR FREE OF ERRORS OR HARMFUL COMPONENTS, OR THAT EMAIL OR OTHER ACTIONS WILL BE SENT OR PROCESSED AS EXPECTED.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADNESS CO. AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

12. Indemnity

You will defend and indemnify Radness Co. and its operator against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your content, your violation of these Terms, or your violation of law or third-party rights (including misuse of Google APIs or email).

13. Suspension and termination

You may stop using the Services at any time and revoke Google access. We may suspend or terminate access immediately if you violate these Terms, if required by law or Google policy, or if continued operation creates risk. Provisions that by nature should survive (including IP, disclaimers, limitations, and indemnity) will survive termination.

14. Export and sanctions

You may not use the Services if you are prohibited under US or other applicable export control or sanctions laws.

15. Governing law and disputes (USA)

These Terms are governed by the laws of the State of Missouri, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Except where prohibited, courts located in Missouri will have exclusive jurisdiction over disputes. Consumers in the EU/UK may have mandatory rights to bring claims in their country of residence.

16. EU consumer terms

If you are a consumer in the EEA/UK, nothing in these Terms limits mandatory statutory rights that cannot be waived by contract. You may be entitled to withdraw from certain distance contracts where applicable law provides a cooling-off right; purely digital services performed with your prior express consent may be exempt as permitted by law.

17. Changes

We may update these Terms by posting a revised version at https://radness.co/terms and updating the date above. Continued use after changes become effective constitutes acceptance, except where additional consent is required by law.

18. Miscellaneous

• If any provision is unenforceable, the remainder remains in effect.
• These Terms are the entire agreement regarding the Services and supersede conflicting prior agreements on the same subject.
• No waiver is effective unless in writing.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
